Terms of Use 

This page states the Terms of Use ("Terms") under which you (“You,” “User”) use www.lacthr.com (“Site,” "LACT HR!"), the online employment search and the LACT HR! Forum. If you do not agree to these Terms, please do not use this Site.

LACT, Inc. ("LACT") may change and update the Terms at any time. Any changes we make will be effective immediately upon notice. Be sure to periodically review the most current Terms because they are binding on You.

The terms "You" and "User" as used herein refer to all individuals and/or entities accessing LACT HR! for any reason. 

LACT HR! Site Restrictions

While using the Site and/or the Services, you acknowledge that LACT expressly prohibits and you agree not to:

  • Provide any inaccurate, untimely, incomplete or misleading information.
  • Post any employment opportunity or requirements that are inaccurate or not available with a verifiable company that is directly represented by your office.
  • Place any contact information within a job posting that is different from or in addition to contact information provided when subscribing to the LACT HR!
  • Post any employment opportunity that does not contain a company URL, e-mail address or "apply online" application.
  • Resell or make available to any individual not expressly licensed by LACT, whether via phone, fax, e-mail, mail or any other medium, any of the LACT services or any information obtained therefrom, including without limitation the Hotlist, resumes or candidate information.
  • Share passwords, login information or user identification or otherwise allow multiple users to access LACT HR! A User is defined as one unique individual user registered with one unique password.
  • Use any search engine, software, tool, agent or other device or mechanism, including without limitation browsers, spiders, robots, avatars or intelligent agents (other than those made available by LACT on the Site or other generally available third party web browsers, e.g., Netscape Navigator or Microsoft Internet Explorer), to navigate or search the Site.
  • Engage in spamming, flooding, soliciting or mass marketing via e-mail, direct mail, telephone, or otherwise to LACT HR! job seekers or subscribers.
  • Express or imply in any way that any statements you make are endorsed by LACT.
  • Impersonate any person or entity, including, without limitation, a LACT employee or agent, a user of LACT's services, including a candidate, placement specialist or an employer, or otherwise misrepresent your affiliation with any person or entity.
  • Respond to a job listing on behalf of anyone other than yourself.
  • Delete or revise any material posted by any other person or entity.
  • Restrict or inhibit any other user from using and enjoying the Site and services, including, without limitation, by means of "hacking" or defacing any portion of the Site.
  • Post or transmit (a) any incomplete, false or inaccurate biographical information or information that is not your own accurate resume (i.e., the resume of a living individual seeking employment on a full-time or part-time basis on his or her own behalf); (b) any content or information that is unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene or otherwise objectionable or harmful, or that infringes on our or any third party's intellectual property or other rights; (c) any advertisements, solicitations, chain letters, pyramid schemes, investment opportunities, or other unsolicited commercial communication; (d) any information or software that contains a virus, worm, Trojan horse or other harmful or disruptive component; (e) any trade secret of any third party; or (f) any material, nonpublic information about companies without the authorization to do so.
  • Use the Site for any unlawful commercial, research or information collecting purposes.
  • Communicate, send, or place unsolicited e-mail, telephone calls, mailings or other contacts to posting individuals and entities.
  • Modify, adapt, sublicense, translate, sell, reverse engineer, decompile or disassemble any portion of the Site.
  • Remove any copyright, trademark, or other proprietary rights notices contained in the Site.
  • "Frame" or "mirror" any part of the Site.
  • Link to any page of or material on the Site other than the URL located at http://www.lacthr.com/.
  • Use any robot, spider, site search/retrieval application, or other manual or automatic device or process to retrieve, index, "data mine," or in any way reproduce or circumvent the navigational structure or presentation of the Site or its contents.
  • Print out or otherwise copy or use any personally identifiable information about candidates for purposes other than consideration of the candidates for potential employment by your company.

LACT assumes no responsibility or liability for any personnel selected by your company. Selection, retention or hire of any individual or entity is based solely on your company's investigation, verification and determination that such hire is suitable for your company's purposes.

Your company agrees to and will hold LACT harmless from any claims, damages or losses incurred by your company or any other party as a result of your use of the LACT HR!

You agree to comply with all applicable laws, rules and regulations in connection with your use of the Site and the Services.

LACT has no obligation to monitor the Site, including any forum, or any materials that you or other third parties transmit or post on to the Site. However, you acknowledge and agree that LACT has the right to monitor the Site, including any forum, and the materials you transmit or post, to alter or remove any such materials (including, without limitation, any posting to the Site), and to disclose such materials and the circumstances surrounding their transmission to any third party in order to operate the Site properly, to protect itself, its sponsors, its registered users and visitors, and to comply with legal obligations or governmental requests. You acknowledge that LACT reserves the right to refuse to post or to remove any information or materials, in whole or in part, that it deems in its sole discretion to be unacceptable, offensive or in violation of this Agreement. LACT also reserves the right to prohibit any user who, in our sole discretion, violates the Code of Conduct or other terms of this Agreement from using the Site and related services. Such prohibition may occur without notice to the user.

This Site may contain links to other web sites operated by third parties, over which we have no control. The Third Party Content may be subject to terms of use and/or privacy policies of such third parties. Please contact the appropriate third party for further information regarding such terms. LACT disclaims all warranties and conditions with regard to contents provided by third parties. You also acknowledge that LACT is not responsible for any content that appears on the Linked Sites. 

Account Registration

In order to use certain Services on the Site, your are required to set up a user name and password. When you register, you agree to provide and maintain accurate, current, and complete information about yourself. You acknowledge that should any information provided by you be found to be untrue, inaccurate, not current, or incomplete, we reserve the right to terminate this Agreement with you and your use of the Site. You also agree to assume sole responsibility for the security of Passwords issued to you. We reserve the right to cancel or suspend your password at any time, including upon the misuse of passwords. You are sorely and entirely responsible for maintaining the confidentiality of your password, and for any and all activities that are conducted through your account

Information you submit at the registration will be used in accordance with LACT HR!’s Privacy Policy.  

User Submission

You are responsible for the information and material that you submit to the Site (each a "Submission"), and that you, and not LACT, will be sorely and entirely responsible for such Submission. Upon your submission of information to the Site, you grant LACT a nonexclusive, worldwide, royalty-free license to link to, distribute, utilize, use, copy, exploit, reproduce, and create derivative works of the Submission. No information you submit shall be deemed confidential. However, LACT agrees to use your information in accordance with LACT HR!'s Privacy Policy applicable to personal information. You retain ownership of any copyrights, trademarks and service marks in any information you submit to LACT HR!  

Trademarks and Copyrights

The trademarks, names, logos and designs ("Trademarks") of LACT HR! or others used on this Site and in the Services are the property of LACT. You may not remove or alter any Trademark, nor use any trademark displayed on the Site or in the Services without the written permission of LACT. All of the Materials appearing on this Site and in the Services, including but not limited to, texts, site design, images and icons, as well as the selection, assembly and arrangement thereof, are the sole property of LACT, Copyright © 2007, unless otherwise specified. Except as otherwise required by applicable law, any reproduction, distribution, modification, retransmission or publication of any copyrighted material is strictly prohibited. 

Indemnity

You acknowledge and agree to defend, indemnify and hold harmless LACT HR! and our affiliates, sponsors, representatives, partners, agents and employees from and against any and all claims, damages, losses, costs (including attorneys' fees) or other expenses that arise directly or indirectly out of or from your use of the Site and/or the Services or breach of these Terms. 

Disclaimer of Warranty

You acknowledge and agree that this Site and/or the Services may include certain errors, omissions, outdated information which may affect the quality of the Materials. You acknowledge that the Materials have not been independently verified or authenticated in whole or in part by LACT, and agree that LACT does not warrant the accuracy or timeliness of the Materials and further agree that LACT has no liability for any errors or omissions in the Materials, whether provided by LACT.

The Site is only a venue allowing for the posting by employers, recruiters and staffing agencies of available job opportunities at their companies or companies they represent (hereinafter referred to collectively as “employers”) and by candidates of their own resumes. LACT does not evaluate or censor the resumes, job listings or other information posted to the Site. Moreover, LACT is not involved in the actual transaction, if any, between potential employers and candidates. Consequently, we have no control over the quality, safety or legality of the job listings or resumes posted to the Site, the truth or accuracy of such job listings or resumes, the ability of employers to hire candidates or the ability of candidates to fill job openings.

LACT, for itself and each of its licensors, makes no representations, warranties, or guarantees as to the quality, suitability, truth, accuracy or completeness of any information or material contained on the Site and/or the Services, including without limitation the materials and any third parties’ content. Unless otherwise explicitly stated, to the maximum extent permitted by applicable law, the Site and/or the Services and any information or material contained on the Site provided to you on an “as is” and “where-is” basis, and is for personal use or internal business use only. All conditions, representations and warranties, neither express, implied statutory or otherwise, including any implied warranty of merchantability, fitness for a particular purpose, or non –infringement of third party rights are hereby disclaimed. LACT provides the services “as-is” without ant warranty of any kind.

You assume total responsibility and risk for your use of the Site and/or the Serivices. YOUR USE OF THE SITE AND ANY MATERIALS PROVIDED THROUGH THE SITE ARE ENTIRELY AT YOUR OWN RISK. 

Limitation of Liability

Neither LACT nor any of its partners, agents, affiliates, content providers, or advertisers are responsible or liable for any form of damages (including, without limitation, direct, indirect, incidental, special or consequential damages) arising out of or related to the use or attempted use of the Site or the Services, including but not limited to, the results of your use of the Site and/or the Services, or any external web sites linked to this Site, or the materials on the Site, however arising, whether for breach or in tort even if LACT was informed of the possibility of such damages.  

Claims of Copyright Infringement

If you believe that your work has been copied on this Site in a way that constitutes copyright infringement and appears on this Site, please provide LACT with the following information:

  • an signature of the person authorized to act on behalf of the owner of the copyright;
  • a description of the copyrighted work that you claim has been infringed;
  • a description of where the material that you claim is infringing is located on the Site;
  • your contact information including your address, telephone number, and email address;
  • a written statement by you that the claimed use is not authorized by the copyright owner, its agent, or the law;
  • a written statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

LACT controls and operates this Site from its headquarters in the United States and makes no representation that the Services or the Materials are appropriate or will be available for use in locations other than the United States. If you use this Site or the Services from outside the United States, you are sorely and entirely responsible for compliance with applicable local laws, including but not limited to the export and import regulations of other countries in relation to the Materials. These Terms will be governed by California law and controlling United States federal law, without regard to the choice or conflicts of law provisions of any jurisdiction. You shall bring all disputes, actions, claims, or causes of action related to these Terms or in connection with this Site only in the federal and state courts located in Los Angeles county, California. If any provision of these Terms is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties, with all other provisions remaining in full force and effect. The failure of LACT to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by LACT in writing.
